This Privacy Notice explains how we collect, use, store and share your personal information when you apply for a role at Quince.
Last Brand Inc (t/a Quince) is incorporated in the United States and has subsidiaries in the United Kingdom and the European Union (together, the “Group”). For the purposes of the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018 and Regulation (EU) 2016/679 (the EU GDPR), Last Brand Inc is the controller of your personal information. Where you apply to a Group company, that entity may also act as a controller.
What personal information do we collect?

Identification information (date of birth, nationality, right-to-work documentation)
Employment history and qualifications
Application materials (CV, cover letter, portfolio or work samples)

Sensitive personal information such as ethnicity, sexual orientation, gender identity, disability or health information (provided voluntarily for equal opportunities monitoring or reasonable adjustments, and processed only with your explicit consent or where required by law)
Any other information you voluntarily provide
How do we collect your personal information?
We may collect personal information about you from the following sources:
From recruitment agencies (where you have been referred)
Directly from you (when you submit an application, attend interviews, or communicate with us)
From referees you have provided
From publicly available sources (such as professional networking sites)
From background check providers (where required for the role)
We may use and process your personal information where it is necessary:
in connection with or in anticipation of a contract - for example, to process your application, communicate with you about your application, and if successful, to prepare your employment contract;
to comply with a legal obligation - for example, to carry out right-to-work checks or to comply with regulatory requirements;
for us to pursue our legitimate interests, for the following purposes;
To assess your suitability, qualifications, and experience for the role
To conduct interviews, tests, and assessments and evaluate the results
To verify information provided and conduct reference and background checks
To establish, exercise, or defend legal claims
To improve our recruitment processes and careers portal
Where we process special category data (such as diversity monitoring information or disability and adjustment requests), we do so only with your explicit consent or where necessary for reasons of substantial public interest.
We may share your personal information with the following categories of recipients where necessary for the purposes described in this privacy notice:
Group companies (our UK and EU subsidiaries and US parent company)
Applicant tracking system and recruitment platform providers
Cloud hosting and infrastructure providers
Background screening and verification providers
Employer of record providers (where a role requires local employment in the UK or EU)
Recruitment agencies (where applicable)
Professional advisers (legal, tax, audit)
IT service and cybersecurity providers
Video interviewing and assessment platform providers
Government authorities and regulators (where required by law)
All third-party service providers processing data on our behalf are bound by data processing agreements and are required to implement appropriate security measures.
We do not sell your personal data to any third party.
Last Brand Inc is headquartered in the United States. When you apply for a role at Quince, your personal information will be transferred to and processed in the United States. The United States has not received a general adequacy decision, so we use appropriate safeguards for transfers of your personal information to the US and other countries without an adequacy decision.
For transfers from the EEA, we rely on the Standard Contractual Clauses adopted by the European Commission in 2021 (the 2021 SCCs). Where providers are certified under the EU-US Data Privacy Framework, we may rely on that as an additional safeguard. For transfers from the UK, we rely on the UK International Data Transfer Agreement or the UK Addendum to the EU SCCs. We conduct transfer impact assessments where required.
We will retain your personal information for as long as is necessary to fulfil the purposes we collected it for, including to satisfy any legal requirements or to establish, exercise, or defend legal claims, or where we have a legitimate interest. We will typically retain your data for no longer than 12 months. You may exercise your right to deletion of your personal information at any time by contacting us using the details below. We will comply unless we have a lawful basis to continue processing it, for example to comply with a legal obligation or to establish, exercise, or defend legal claims.
You have a number of rights in relation to your personal information. You are entitled to:

Deletion of your personal information in certain circumstances
Restriction of how we process your personal information
Transfer of your personal information to another organisation (data portability)
